SCRAP TYRE RECYCLING REGULATIONS

End of life tyres are classified as controlled waste and are subject to specific environmental laws.

Waste Tyre Disposal

If your business produces waste tyres or as an individual you have waste tyres to dispose of, by law you have a duty of care to ensure that their disposal complies with the Waste Duty of Care code of practice. This duty of care extends so "You have a responsibility to take all reasonable steps to ensure that when you transfer waste to another waste holder that the waste is managed correctly throughout its complete journey to disposal or recovery."

Your Choice

As the producer of the waste tyres you now have two choices: use a registered waste carrier or a licensed waste tyre processor to collect them.

A waste carrier does not process waste tyres

Waste Carriers

Any individual or company can register as a waste carrier, broker and dealer: It's quick, simple and low cost, presently £154 for 3 years. A waste carrier does not process waste tyres but consolidates and/or sorts them before delivering them to a licensed waste tyre processor such as Envirotyre. This is all enabled by a waste exemption:
"S2 storing waste in a secure place."
"This exemption allows you to store specific waste at a secure place that is different to where the waste was produced, before the waste is transported to another site to be recovered."

Waste Carrier Limitations

Waste carriers are limited to the number of tyres that they can store, now the limit is 40 tonnes for 3 months. A key condition of this allowance is the storage is awaiting its recovery elsewhere.
Therefore, as the producer of the waste tyres your responsibility has not ended when they are collected by a waste carrier as this is only an intermediate step before disposal or recovery.

Waste Tyre Processors

If your tyres are collected by Envirotyre your responsibility for their correct disposal is discharged when we collect them as we are licensed by the Environment Agency as a waste tyre processor. We operate under permit number QP3096EJ/A001 and our waste management licence number 102150. This is one of the cornerstones of our business and cost us tens of thousands of pounds. We also had to invest heavily in our specialised site with its machinery, fire control, security and environmental protection.

Footnote

There are many articles in the press about waste carriers going out of business. A loophole in the law allows unscrupulous businesses to collect waste tyres and stockpile them until either their site can hold no more or they are reported and then closed by the Environment Agency. Unfortunately the tyres remain long after the business has disappeared and often we are called in to clear up.
